- Texas closings are handled by a title company escrow officer. An attorney is not required.
- Transfer tax
- Texas has no real estate transfer tax, and the Texas Constitution has barred new ones since 2016.
- Foreclosures
- Most Texas foreclosures are non-judicial trustee's sales held on the first Tuesday of the month at the county courthouse. A homeowner must get at least 20 days to cure and 21 days' notice of sale, and there is no redemption after a mortgage foreclosure sale.
- Wholesaling and assignments
- Texas Occupations Code 1101.0045 and Property Code 5.0205 (effective January 1, 2024) require written disclosure to the seller of your intent to assign, and to the buyer that you are selling only a contract interest.
- Also worth knowing
- Texas is a non-disclosure state: sale prices are not public record, so comps usually come from the MLS or appraisers.
