Buying an Investment Property in New Jersey

Closings
New Jersey does not legally require an attorney at closing. In North Jersey both sides usually hire attorneys, while in South Jersey title companies often close deals without them.
Transfer tax
The seller pays New Jersey's Realty Transfer Fee, which is set in price bands starting at $2.00 per $500 of the price. Since July 10, 2025, sales over $1 million also carry a seller-paid graduated fee of 1% to 3.5% of the full price, replacing the old 1% buyer-paid mansion tax.
Foreclosures
New Jersey foreclosure is judicial and goes through the Superior Court, with the county sheriff holding the sale. The owner generally has 10 days after the sheriff's sale to redeem by paying the full judgment amount.
Wholesaling and assignments
New Jersey has no wholesaling statute yet. Bill A4278, which would require a license and give sellers a 30-day cancellation right, is pending in an Assembly committee.
Also worth knowing
New Jersey's lead-safe law (P.L.2021, c.182) requires most rental units built before 1978 to be inspected for lead paint hazards, including at tenant turnover. A lead-safe certificate is valid for two years.
